U.S. Solicitor General Noel Francisco, the government’s advocate before the Supreme Court, said in a filing that whatever flaws may have existed in the temporary bans, the current version, which was published in September, satisfied legal requirements and should go into immediate effect…
The state of Hawaii, among others, has argued that the current regulation is as illegal as the prior iterations, and last month a federal judge in Honolulu agreed.
U.S. District Judge Derrick Watson found that the ban discriminated against nationals of specified countries without adequate justification. He issued an order halting its implementation against travelers from Chad, Iran, Libya, Somalia, Syria and Yemen. Restrictions imposed on visitors from North Korea, as well as some government officials in Venezuela, weren’t challenged in the suit and the judge permitted them to take effect…
A similar suit against the travel ban is proceeding in Maryland, where a federal district judge likewise has blocked implementation. The Justice Department said it also would seek a stay of that order.”
