CONSUMER PROTECTION/LEGAL/NOMINATIONS/TRUMP AS PRESIDENT: “The Trump administration urged a federal judge to reject an Obama-era official’s attempt to assert command over the Consumer Financial Protection Bureau, arguing in a court filing it had properly installed its own official to run the agency.
In an overnight filing Monday [11-27-17], the Justice Department said the CFPB’s deputy director, Leandra English, ‘cannot establish the likelihood of success on the merits of her claim’ to be interim director of the CFPB. Justice lawyers said legal precedent supports the Trump administration’s move to put Mick Mulvaney, the White House’s budget director, in charge until a permanent nominee is chosen and confirmed, under a law on government vacancies…
A federal judge reviewing dueling claims over the CFPB’s interim leadership said Monday he would act quickly after the Trump administration filed its response to Ms. English’s request for a temporary restraining order…
The case hinges on whether the Federal Vacancies Reform Act of 1998, which grants the president authority to appoint an acting head of an agency in the event of a vacancy, supersedes the Dodd-Frank Act, which created the CFPB and laid out succession guidelines for the agency.”
